1. Acceptance of Terms

By accessing or using Comrade Hustle ("the Platform"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using the Platform.

2. Platform Description

Comrade Hustle is a marketplace platform that enables users ("Sellers") to create and manage their own online stores and connect with potential customers ("Buyers"). The Platform acts solely as a venue for connecting Buyers and Sellers and does not participate in any transactions between them.

3. User Responsibilities

3.1 Seller Responsibilities

• Provide accurate store information and product details
• Handle all customer inquiries and support directly
• Manage order fulfillment, shipping, and delivery
• Process returns, refunds, and resolve disputes directly with buyers
• Comply with all applicable laws and regulations

3.2 Buyer Responsibilities

• Verify seller credibility and product quality before purchasing
• Contact sellers directly for order-related inquiries
• Understand that transactions are between buyer and seller only

4. No Transaction Liability

Important: Comrade Hustle is not a party to any transactions between Buyers and Sellers. We do not:

• Process payments or handle financial transactions
• Guarantee product quality, authenticity, or delivery
• Provide refunds or handle disputes between users
• Verify the accuracy of product listings or seller information
• Assume any liability for transactions gone wrong

All transactions are conducted directly between Buyers and Sellers at their own risk.

5. Premium Services

5.1 Subscription

Premium services are available for 249 KES per month, providing enhanced features for Sellers.

5.2 Refund Policy

Refunds for premium subscriptions are only available within 7 days of initial purchase. To be eligible for a refund:

• Request must be made within 7 days of subscription
• No refunds after 7 days under any circumstances
• Refunds are processed to the original payment method
• Refunds may take 5-10 business days to process

5.3 Subscription Terms

• Subscriptions automatically renew monthly
• Users must cancel before renewal to avoid charges
• No prorated refunds for partial months

6. Prohibited Activities

Users are prohibited from:

• Listing illegal, counterfeit, or prohibited items
• Engaging in fraudulent activities
• Infringing on intellectual property rights
• Harassing other users
• Circumventing platform fees
• Using the platform for any unlawful purpose
• Misrepresenting products or services
• Creating multiple accounts to abuse promotions

7. Intellectual Property

Users retain ownership of their content but grant Comrade Hustle a license to display and distribute it on the Platform. The Comrade Hustle brand, logo, and platform technology are owned by us.

8. Limitation of Liability

To the fullest extent permitted by law, Comrade Hustle shall not be liable for:

• Any transactions between Buyers and Sellers
• Product quality, safety, or authenticity
• Delivery issues or non-delivery
• Financial losses or damages
• User disputes or conflicts
• Technical issues or platform downtime
• Third-party actions or content

Total liability shall not exceed the amount paid by you to Comrade Hustle in the past 6 months.

9. Indemnification

You agree to indemnify and hold harmless Comrade Hustle, its owners, employees, and affiliates from any claims, damages, or expenses arising from your use of the Platform or violation of these terms.

10. Termination

We reserve the right to suspend or terminate accounts that violate these terms. Users may terminate their accounts at any time.

11. Changes to Terms

We may modify these terms at any time. Continued use of the Platform constitutes acceptance of updated terms.

12. Governing Law

These terms are governed by the laws of Kenya. Any disputes shall be resolved in the courts of Kenya.
